Rental Policies & Waivers FAQ
1. Who can rent equipment or join a group event?
Participants must be 18 or older, or accompanied by a parent/guardian. Minors under 16 may not rent or operate e‑bikes. All participants must be physically able to safely use the equipment and join the activity.
2. What equipment is included with my rental or event?
Depending on the activity, we may provide:
- E‑bikes or standard bikes
- Kayaks or other paddlecraft
- Snowshoes or skis
- Helmets (required for bikes/e‑bikes)
- Life vests (required for kayaks/paddlecraft)
- Poles, paddles, and other needed accessories
We do not supply equipment for recreational events. It is assumed that participants provide their own or arrange a rental.
3. What safety rules do I need to follow?
- Wear helmets and life vests whenever required
- Follow policies and instructions at all times
- Follow Idaho laws, trail rules, and waterway regulations
- Ride or paddle in a controlled, predictable way
- Not participate under the influence of alcohol, cannabis, or other impairing substances
Unsafe behavior may result in removal from the activity without a refund.
4. What is your rental cancellation and refund policy?
All rentals are non‑refundable unless canceled or changed at least 48 hours before the start time. Late arrivals, no‑shows, or early returns are not eligible for refunds.
5. Am I responsible if equipment is damaged, lost, or stolen?
Yes. The renter is responsible for damage, loss, or theft of equipment up to the replacement value of the item not to exceed $4,000 per item. Equipment must be returned clean, dry, and on time. Late returns may result in additional fees.
6. What happens if a guided tour is affected by weather or conditions?
Events run rain or shine unless conditions are unsafe. We may change routes or cancel due to weather, wildfire smoke, or trail closures. If we cancel for safety reasons, you may receive a reschedule or credit. We do not offer refunds for late arrivals, no‑shows, or early departures.
7. What risks should I be aware of?
Outdoor activities involve inherent risks, including:
- Falls, collisions, capsizing, or loss of control
- Weather, water, terrain, wildlife, and natural hazards
- Equipment malfunction or improper use
- Physical exertion, cold exposure, or fatigue
By booking, you voluntarily assume these risks.
8. What liability do I agree to when I book?
To the fullest extent allowed by Idaho law, you agree to:
- Release Elk River Outdoors, LLC from liability for injury, property damage, or accidents arising from participation (excluding gross negligence or willful misconduct)
- Accept responsibility for your own actions and equipment use
- Indemnify and hold Elk River Outdoors harmless from claims arising from your participation
9. What if I’m booking for a minor?
Parents/guardians who book for a minor:
- Accept all terms on the minor’s behalf
- Assume full responsibility for the minor’s safety
- Agree to indemnify the Company for any claims involving the minor
- Acknowledge that minors under 16 may not use e-bikes
